1. Introduction and Acceptance of Terms

Welcome to Baker App! These Terms of Service ("Terms") govern your use of our mobile application and website, collectively referred to as the "Services."

By accessing or using Baker App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and Baker App. Please read them carefully.

2. Description of Service

Baker App is a recipe management application designed specifically for baking enthusiasts. Our Services include:

• Recipe creation, storage, and organization
• Recipe version tracking and history
• Custom ingredient management with hydration calculations
• Timer management with notifications
• Cloud synchronization across devices (for signed-in users)
• Subscription-based premium features

We offer both free and paid subscription tiers with varying feature limits, as detailed in Section 4 below.

3. Account Registration and Security

3.1. Account Creation

You may use Baker App without creating an account (with limited features). To access cloud sync and higher feature limits, you must create an account by providing:

• A valid email address
• A secure password, or
• Authentication through a third-party provider (Google or Apple)

3.2. Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your account information is accurate and up-to-date

3.3. Age Requirement

You must be at least 13 years old to use Baker App. By creating an account, you represent that you meet this age requirement.

3.4. Account Termination

You may delete your account at any time through the app settings. Upon deletion:

• All your recipes, timers, and custom ingredients will be permanently deleted
• Your subscription will be cancelled (no refunds for remaining subscription period)
• This action cannot be undone
• Account deletion is completed within 30 days

4. Subscription Plans and Pricing

4.1. Service Tiers

Baker App offers three service tiers:

Paid subscriptions are available at the following prices:

• Monthly: $4.99 per month
• Annual: $39.99 per year (save approximately 33%)

Paid subscriptions are currently available only for United States and Ukraine billing addresses. Prices are in USD and may be shown before applicable taxes.

4.3. Auto-Renewal

Your subscription will automatically renew at the end of each billing period (monthly or annual) unless you cancel before the renewal date. You will be charged the then-current subscription price.

You authorize us to charge your payment method automatically on each renewal date. It is your responsibility to ensure your payment information is current.

4.4. How to Subscribe

Subscriptions are purchased through our website (not through Apple or Google app stores). When you reach a feature limit in the mobile app, you can manage your account on our website.

Important: Because subscriptions are purchased through our website, Apple Inc. and Google LLC are not responsible for subscription management, billing, or support.

4.5. Payment Processing

All payments are processed securely by Paddle, our Merchant of Record and payment processor. We do not store your credit card information. By subscribing, you agree to Paddle's applicable checkout terms and privacy policy.

4.6. Price Changes

We reserve the right to change our subscription prices at any time. Price changes will:

• Be communicated to you at least 30 days in advance via email
• Not affect your current billing period
• Take effect on your next renewal date
• Give you the option to cancel before the price change takes effect

5. Cancellation and Refunds

5.1. How to Cancel

You may cancel your subscription at any time by:

• Visiting your account page on our website
• Clicking "Manage Subscription"
• Following the cancellation instructions provided by Paddle

Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date.

5.2. Refund Policy

All subscription fees are non-refundable. This is standard for digital subscription services. Specifically:

• We do not offer refunds for partial months or unused time
• If you cancel, you retain access until the end of your paid period
• We do not prorate refunds for early cancellation
• Downgrading from paid to free does not result in a refund

Exceptions: We may offer refunds at our sole discretion in cases of:

• Billing errors or duplicate charges
• Technical issues that prevent you from using the service
• Other exceptional circumstances

5.3. Effect of Cancellation

When your subscription ends (either by cancellation or non-payment):

• Your account reverts to the Free (Signed In) tier
• You retain access to all your recipes, but are subject to free tier limits
• If you exceed free tier limits, you must delete content or upgrade to access it
• Cloud sync continues to work for your account

6. User Content and Ownership

6.1. Your Content

You retain full ownership of all recipes, instructions, custom ingredients, and other content you create in Baker App ("Your Content").

6.2. License to Us

By using our Services, you grant us a limited, non-exclusive, royalty-free license to:

• Store Your Content on our servers
• Sync Your Content across your devices
• Make backup copies for data protection
• Display Your Content back to you in the app

This license exists solely to provide you with our Services. We will not use Your Content for any other purpose without your permission.

6.3. Content Guidelines

You may not use Baker App to create, store, or share content that:

• Is illegal, harmful, or promotes illegal activity
• Infringes on intellectual property rights of others
• Contains malicious code or viruses
• Violates any applicable laws or regulations

We reserve the right to remove content that violates these guidelines or suspend accounts that repeatedly violate them.

6.4. Data Backup and Loss

While we make reasonable efforts to backup your data:

• We are not responsible for loss or corruption of Your Content
• You should maintain your own backups of important recipes
• We recommend periodically exporting your recipes

7. Prohibited Activities and User Conduct

You agree to use Baker App only for lawful purposes and in a way that does not infringe the rights of others. Prohibited activities include:

• Attempting to gain unauthorized access to our systems or other users' accounts
• Using automated systems, scripts, or bots to access the Services
• Reverse engineering, decompiling, or disassembling the app
• Interfering with the proper functioning of the Services
• Uploading viruses or malicious code
• Circumventing feature limits or subscription requirements
• Creating multiple accounts to bypass limits
• Sharing your account with others
• Reselling or redistributing our Services
• Scraping or extracting data from our Services

Violation of these prohibitions may result in immediate termination of your account without refund.

8. Intellectual Property

All content, features, and functionality of Baker App, including but not limited to:

• Software code, design, and architecture
• User interface and user experience design
• Graphics, logos, and branding
• Text, documentation, and help content
• Features and functionality

are the exclusive property of Baker App and its licensors, and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from our Services, except for your own personal, non-commercial use as permitted by these Terms.

9. Third-Party Services

Baker App integrates with and relies on several third-party services:

• Clerk: Authentication and identity management
• Convex: Database and backend services
• Paddle: Merchant of Record, payment processing, tax handling, and subscription management
• PostHog: Analytics (with your consent)
• Sentry: Error tracking

Your use of these services through Baker App is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of these third-party services.

Baker App may contain links to third-party websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites.

10. Disclaimers and Limitations of Liability

10.1. Service Availability

BAKER APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

• The Services will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Services will be accurate or reliable
• The quality of any products, services, information, or other material obtained through the Services will meet your expectations
• Any errors in the software will be corrected

10.2. Recipe Information

Important Disclaimer: Baker App provides tools for managing and organizing baking recipes. However:

• We do not guarantee the accuracy of recipes, measurements, or calculations
• Hydration calculations and conversions are provided as estimates
• You are responsible for verifying recipe information before use
• We are not responsible for any food safety issues or outcomes from following recipes

10.3. Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL BAKER APP, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:

• Direct, indirect, special, incidental, consequential, or punitive damages
• Loss of revenue, profits, business, anticipated savings, use, goodwill, or data
• Personal injury, pain and suffering, or emotional distress
• Loss or corruption of Your Content
• Service interruptions or downtime

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Baker App and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

• Your access to or use of the Services
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your Content or any content you submit through the Services

12. Termination by Us

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause or notice, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Services
• Non-payment of subscription fees
• At our sole discretion for any reason

Upon termination:

• Your access to the Services will be immediately revoked
• We may delete Your Content from our servers
• You will not be entitled to any refund of subscription fees
• Provisions of these Terms that by their nature should survive termination will survive

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date at the top
• Sending an email notification to your registered email address
• Displaying an in-app notification

Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Services and may cancel your subscription.

14. Dispute Resolution and Governing Law

14.1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without giving effect to any choice or conflict of law provision or rule.

14.2. Dispute Resolution

Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the competent courts of the Netherlands, and you consent to the jurisdiction of such courts.

14.3. Informal Resolution

Before filing a formal claim, you agree to contact us at legal@baking-app.com to attempt to resolve the dispute informally.

15. Apple and Google Specific Terms

15.1. Apple App Store

If you access Baker App through the Apple App Store:

• These Terms are between you and Baker App only, not with Apple Inc.
• Apple has no obligation to provide any maintenance and support services
• Apple is not responsible for addressing any claims relating to the app
• Apple is not responsible for any product liability claims
• Apple is not responsible for any intellectual property infringement claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms

15.2. Google Play Store

If you access Baker App through Google Play:

• These Terms are between you and Baker App only, not with Google LLC
• Google has no obligation or liability with respect to the app
• You agree to comply with Google Play's Terms of Service

15.3. Web-Based Subscriptions

Important Notice: Baker App subscriptions are purchased through our website, not through Apple or Google in-app purchases. Therefore:

• Apple and Google are not involved in subscription billing or management
• You must manage your subscription through our website
• Subscription support is provided by Baker App, not Apple or Google

16. General Provisions

16.1. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Baker App regarding the Services.

16.2. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16.3. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16.4. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
